JUDICIAL AUTONOMY UNDER AUTHORITARIAN ATTACK
Project description
The interdisciplinary research project Judicial Autonomy under Authoritarian Attack funded by Einstein Foundation Berlin deals with one crucial aspect of “democratic backsliding” in Europe by analyzing possible patterns behind populist-authoritarian attacks on judicial independence. It aims at identifying judicial, political, and institutional constellations which are susceptible to such attacks in varying degrees. Using a variety of empirical social science methods, the project will collect cross-case data from forty-seven Council of Europe member-states on institutional properties of the judicial systems and its legal amendments between 2000 and 2020. Specific cases for an in-depth qualitative analysis will be selected based on the outcome of this large-N comparison using fuzzy set QCA. From this sample, constellations in which populist-authoritarian restructuring efforts have succeeded will be contrasted with cases where the attacks have heretofore been met with important resistance.
